Important facts about land registration

 

The Land Reform Act is not about compulsory purchase or forced sales. Current land owners are under no obligation to sell.

Registration gives the people of Kinghorn the opportunity to buy only when land comes on the market.

A formal community ballot is required before any and every purchase. No application to purchase can be made without this.

If a ballot is successful - and the application to purchase the land is allowed to proceed by the Scottish Executive, a "Fair Market Price" will be determined by an independent valuer appointed by the Executive.

The landowner can take the land back off the market at any time.

KCLA would apply for the bulk of the costs to the Lottery ‘Growing Community Assets Fund’, created to fund local communities to buy land and buildings that will help them become stronger and more sustainable’.

Kinghorn will face more development pressure. Registration gives Kinghorn people more influence to secure the future the community wants for this land.

We are starting a process. The plans are sound but not set in stone. We are starting detailed business, land management and financial planning to realise the vision over time. Consultation is central to that.
